So far it looks like If The World and Madagascar has been copyrighted. I searched for all the other songs and not nothing  :(

there must be a way we can find out what track #2 is....

i mean surely everytime these get leaked there is a copyright claim or something made by the band which would include the title :/

I just noticed something. "Madagascar" and "If The World" were copyrighted a month after the antiquiet.com leaks

and maybe this is why the fbi are having a hard time bringing a case against that guy...

By law I wouldn't think they could, that's why the damn law was created. This leads me to second guess whether Axl had anything to do with the arrest or not. I mean it was stated that Universal tipped off the FBI. Why would Universal rat the guy out over songs that aren't copyrighted, if they were supposedly set for release?

once a work has been created, it is automatically copy written. as long as the band can show proof that it is their material, they have ownership. regardless if it has been formally submitted or not, once there is some level of proof as to who wrote it, when it was recorded, etc...the copyright is held by the creator. as we all know madagascar has been played live under the GNR name for a number of years and been uncontested that it is theirs. i am sure there are labeled(even electronically) tapes to prove that the rest of the, newer unknown material, is also theirs. not to mention the number of musicians, engineers, producers, etc, who can also attest to whose material it is. i doubt the fbi are having much of a problem with evidence. a federal case is not going to go flying through the courts in a matter of days. these things take time.
